General conditions of sale and delivery on the Point Art BG platform is a statement with which we disclose the conditions and arrangements for the purchase and delivery of products Point Art BG,
to assist its visitors and to comply with legal requirements for e-commerce.
I. SUBJECT
Article 1. These general terms and conditions are intended to regulate the relations between POINT ART 2015 EOOD, Plovdiv, Emil de Lavele Str. № 2, UIC 203793551, represented by Svetla Andonova, hereinafter referred to as SUPPLIER , and customers, hereinafter referred to as USERS, of the e-shop www.pointartbg.com, hereinafter referred to as "E-SHOP".

III. CHARACTERISTICS OF E-SHOP
Art. 3. POINT ART BG is an e-shop, available at the Internet address www.pointartbg.com, through which Users have the opportunity to enter into contracts for sale and delivery of products offered by the E-SHOP / goods and / or services /, including the following:
To register and create a profile for viewing the E-SHOP and use the additional services to provide information
To make electronic statements in connection with the conclusion or execution of contracts with the E-SHOP through the interface of the E-SHOP page, available on the Internet
To conclude contracts for purchase and sale and delivery of the products offered by the E-SHOP
To make any payments in connection with the concluded contracts with the E-SHOP, according to the ones maintained by the E-SHOP payment methods
To receive information about new products offered by the E-SHOP
To review the products, their characteristics, prices and delivery conditions;
To be notified of the rights arising from the law mainly through the interface of the E-SHOP page on the Internet
Art. 4. The Supplier delivers the products and guarantees the rights of the Users, provided by law, within the framework of good faith, the criteria and conditions adopted in practice, consumer or commercial law.
Art. 5. (1) Users enter into a contract for purchase and sale of products offered by the E-SHOP through the interface of the Provider, available on its website at www.pointartbg.com or other means of distance communication.
(2) Users of the E-SHOP service may be only persons who can make a valid and binding declaration of intent and have reached 18 years of age
(3) By virtue of the contract concluded with the Users for purchase and sale of products, the Provider is obliged to deliver and transfer the ownership of the User to the products determined by him through the interface.
(4) The Users pay to the Provider remuneration for the delivered goods according to the conditions determined on the E-SHOP and the present general conditions. The remuneration is in the amount of the price announced by the Provider at the address of the E-SHOP on the Internet.
(5) The Provider delivers the products ordered by the Users within the terms and under the conditions determined by the Provider on the website of the e-shop and according to the present general conditions.
(6) The price for the delivery shall be determined separately and explicitly from the price of the products.
IV. USER PROFILE. USE OF E-SHOP
Art. 6. (1) In order to use the E-SHOP for concluding contracts for purchase and sale of products, the User should enter his chosen name and password for remote access, in cases where the e-shop requires registration.
(2) The name and the password for remote access are determined by the User, by registration electronically on the website of the Provider.
(3) By filling in his data and pressing the buttons "I accept" and "Registration", the User declares that he is familiar with these general conditions, agrees with their content and undertakes to comply with them unconditionally.
(4) The Provider confirms the registration made by the User by sending a letter to the e-mail address specified by the User, to which information for activating the registration is also sent.
(5) Upon registration, the User undertakes to provide accurate and up-to-date data. The user promptly updates the data specified in his registration in case of change.
(6) Upon registration, the User should familiarize himself with the Privacy Policy of POINT ART BG and accept his personal data to be processed under the conditions set out therein.
(7) In case a profile in web social networks or other networks is used for registration of the User, a party to the contract is the person who is the holder of the profile used for registration in the respective social or other network. In this case, the Provider has the right to access the data necessary to identify the User in the relevant social or other network.
V. TECHNICAL STEPS FOR PERFORMANCE OF PURCHASE AND SALE
Art. 7. (1) The users mainly use the interface on the page of the Provider, for carrying out purchase and sale of the offered by Supplier products in the E-SHOP.
(2) The purchase and sale shall be carried out in Bulgarian or English.
(3) The user buys products offered on a platform with a web address www.pointartbg.com
(4) To perform a purchase and sale, the User uses the data provided during registration (if mandatory). In case the registration of a user profile has not been created, the User is obliged to provide name, surname, contact phone number and delivery address of the products purchased by him from the E-SHOP www.pointartbg.com.
(5) The Provider is obliged to inform the User about all details, irregularities, unavailable / exhausted products, etc. electronically or by phone call to the contact phone provided by the User.
(6) The purchase and sale is considered to be made at the moment when the User goes through all the steps of shopping from the E-SHOP www.pointartbg.com. and receive the number of your electronic order / purchase.
(7) The Provider sends information about the online purchase to the e-mail address of the User, provided during the purchase and sale.
(8) The Supplier delivers the products to the address indicated by the Users and is not responsible in case the data indicated by the Users are incorrect or misleading.
Art. 8. (1) The users carry out purchase and sale with the Provider under the following procedure:
Execution of registration of a USER PROFILE in the E-SHOP and provision of the necessary data, if the User has not yet registered in the E-SHOP
Entering the system for placing orders in the E-SHOP by identifying with a name and password
Selecting one or more of the offered products of the E-SHOP and adding them to the list of goods for purchase - CONSUMER BASKET
Providing delivery details
Choice of method for payment of the price / total value of ordered products
Order confirmation
(2) Users have the opportunity to make a purchase from the E-SHOP without the mandatory registration of a user profile. Shopping as a guest without registration on the Provider's website is as follows:

Select one or more of the products offered in the E-SHOP and add them to the list of goods for purchase

VI. SPECIAL OBLIGATIONS OF THE SUPPLIER. CONSUMER PROTECTION
Art. 9. (1) The main characteristics of the goods in order to support the making of an informed choice when purchasing the product / s offered by the Supplier are defined in the detailed page of each item on the site of the E-SHOP.
(2) The price of the products including all taxes is determined by the Supplier in the detailed page of each product on the site of the E-SHOP.
(3) The value of the postage and transport costs, not included in the price of the products, shall be determined by the Provider and shall be provided as information to the Users in one of the following moments:
- In the detailed page of the Terms of Delivery, presented on the Site of the Provider of E-SHOP
- When choosing the goods for purchase and sale;
(4) The manner of payment, delivery and performance of the contract is determined in these general terms and conditions, as well as the information provided to the User on the website of the Provider.
(5) The information provided to the Users under this article is up-to-date at the time of its visualization on the website of the E-SHOP Provider before the conclusion of the sales contract and the presence of discrepancies between the announced and actual dimensions for framing, changes in the design of the products and their packaging, for which the Supplier is not responsible, the information on framing and dimensions published on the site must be interpreted as indicative.
(6) The supplier must indicate the conditions for delivery on the website of the E-SHOP.
(7) The supplier shall indicate before finalizing the purchase and sale the total value of the order for all products contained therein.
(8) Deliveries with cash on delivery and payment upon receipt of the order shall be considered applicable only for requested orders for deliveries to an address in the territory of the Republic of Bulgaria or to an address of a POINT ART BG store. In all other cases, this method of payment and execution of an order is inapplicable and orders with such details will be canceled on the basis of this article.
(9) If you wish to receive the ordered products from our art store in Plovdiv, you do not owe and do not pay for courier services to the announced price of the products. If you do not pick up the ordered products from a POINT ART BG store within 10 calendar days of the order, it will be officially canceled.
(10) For sale and export outside Bulgaria of works of art / objects, which do not have characteristics of cultural value and do not meet the definition of cultural value in the sense of art. 7 of the Cultural Heritage Act, a Certificate is issued by a Commission to the National Gallery, which will be attached to the picture you requested. In this case you add three working days / + 3 days / to the announced delivery time, as the total delivery time by POINT ART BG cannot exceed 21 days.
(11) All delivery terms are in working days, unless "calendar days" are explicitly written.
Art. 10. (1) The user agrees that the Supplier has the right to accept advance payment for the concluded with the consumer contracts for purchase and sale of products and their delivery.
(2) The consumer chooses independently whether to pay the Supplier the price to deliver the products before or at the time of delivery.
Art. 11. (1) The user has the right, without paying compensation or penalty and without stating a reason, to return the purchased goods from E-SHOP www.pointartbg.com within 14 calendar days from the date of receipt of the goods, the transport costs are the responsibility of the Buyer (User).
(2) In case the consumer exercises his right of refusal under para. 1, the Provider shall be obliged to reimburse in full the amounts paid by the consumer not later than 14 calendar (non-working days), as of the date on which the consumer has exercised his right to withdraw from the concluded contract. The costs paid for the return of the goods are deducted from the amount paid by the consumer under the contract, unless the consumer has returned the goods at his own expense and has notified the Supplier.
(3) The consumer is obliged to store the products received from the Supplier, their quality and safety during the term under para. 1.
Art. 12. (1) The term of delivery of the products and the initial moment from which it runs is determined for each product separately when making a sale with the consumer through the site of the Supplier of E-SHOP, unless the products are ordered in one delivery.
(2) If the Provider cannot fulfill the delivery due to the fact that he does not have the ordered products, he is obliged to notify the consumer and to refund the amounts paid by him (if the User has paid in advance by one of the proposed payment methods), in case the User does not want to choose another product to replace the one that is not available / exhausted.
(3) In cases where the Supplier does not have the ordered products, he has the right to offer the consumer products with similar characteristics, the same quality and price.
(5) In case of exercising the right of refusal to purchase products under para. 3, the costs of returning the goods are at the expense of the Supplier.
Art. 13 The User must inspect the goods at the time of delivery and delivery by the Supplier and if it does not meet the requirements to notify the Supplier immediately.
VII. PROTECTION OF PERSONAL DATA
Art. 14. (1) The Provider shall take measures for protection of the personal data of the User according to the Personal Data Protection Act and the European legislation.
(2) For reasons of security of the personal data of the Users, the Provider will send the data only to the e-mail, which was indicated by the Users at the moment of registration.
(3) The Provider accepts and announces on its website a Privacy Policy, available at www.pointartbg.com, with which each user of the website should get acquainted.
Art. 15. At any time, the Provider has the right to require the User to identify himself and certify the authenticity of each of the circumstances and personal data announced during registration.
VIII. AMENDMENT AND ACCESS TO THE GENERAL TERMS
Art. 16. (1) These general terms and conditions may be amended by the Provider, for which the latter will notify in an appropriate manner all Users of the E-SHOP who have registration.
(2) The Provider and the User agree that any addition and amendment of these general conditions will have effect on the User after their publication by the Provider and if the User does not declare within 14 days that he rejects them.
Art. 17. The Provider publishes these general conditions at www.pointartbg.com together with all additions and amendments thereto.
IX. ELECTRONIC BULLETIN - NEWSLETTER AND BLOG
Art. 18. By registering and agreeing to the General Terms of Use of the site, each user may agree, in accordance with the Privacy Policy of POINT ART BG to receive newsletters from POINT ART BG containing information about promotions and activities, as well as the organization of future ones for commercial and marketing purposes.
Art. 19. Subscribing to receive a newsletter is possible without mandatory registration on the site! Any online user can request a newsletter using the "Subscribe to Newsletter" button.
Art. 20. Users may express their refusal to receive a newsletter at any time by using the attached link in each e-newsletter or by sending an e-mail with the text DELETE to point.art2015@gmail.com . Refusal to receive a newsletter does not mean refusal to register on the site (if any)!
X. OTHER CONDITIONS
Art. 21. These general terms and conditions enter into force for all Users of www.pointartbg.com
